Terms of Service

Welcome to The Reviewery ("the app", "we", "us"), operated by Heap Brands, a sole proprietorship registered in British Columbia, Canada. By creating an account or using the app or revieweryapp.com you agree to these terms. If you don't agree, don't use them.

1. What The Reviewery is

The Reviewery is a community app for reviewing breweries and brewpubs on three things — Beer, Staff and Vibe — and for logging the beers you drink. Pubs, taphouses and bottle shops may appear on the map for convenience but can't be reviewed. Browsing is open to everyone; contributing (reviews, pours, photos, adding a brewery, claiming one) requires a signed-in account. The Reviewery is offered in Canada and the United States.

2. Age

You must be of legal drinking age where you live (19+ in most of Canada, 18+ in Alberta, Manitoba and Quebec, 21+ in the United States) to create an account. The app contains frequent references to alcohol.

3. Your account

You sign in with your Apple ID and are responsible for what happens on your account. One person, one account. You may delete your account at any time in Settings → Delete account; this permanently deletes your profile and the content you posted, as described in the Privacy Policy.

4. Your content

You keep ownership of the reviews, pours, photos and other content you post. By posting, you grant us a worldwide, royalty-free licence to host, display, reproduce and distribute that content within the app, on revieweryapp.com share pages, and in anonymous aggregate form (for example, a brewery's average scores) for as long as it remains on the service. You can edit or delete your own reviews and pours at any time; nobody else can change your review. You agree not to post content that is unlawful, hateful, harassing, sexually explicit, violent, deceptive, spam, or that infringes anyone's rights. See the Community Guidelines.

5. Moderation

Every photo you add — to a brewery, a review, a pour, or as a profile picture — is screened automatically before it becomes visible. Review text and pour notes are filtered at posting for explicit slurs and scanned after posting for content that breaks the Community Guidelines; anything flagged goes to a human moderator. We may remove content or restrict accounts that violate these terms or the Guidelines, with or without notice. You can report any content and block any member from within the app; a blocked member's content is hidden from you.

6. Integrity of scores

A brewery's scores are the plain mean of genuine member reviews. Nobody — including a brewery, claimed or not, and including us — can pay to change a score, a ranking or a search position, and we don't edit scores by hand. Attempting to manipulate scores (fake accounts, incentivized or traded reviews, reviewing your own brewery, review-bombing) is a violation of these terms and may result in removal of content and accounts.

7. Claimed breweries

A person who runs a brewery may claim its page. We verify a claim by calling the phone number on the brewery's own website or public listing, or by a reply from an email address at the brewery's own domain. A claimed brewery may keep its hours, phone, website and Instagram accurate and may manage its tap board. In return it agrees to: keep that information true; not list beers that aren't pouring; not review or rate its own brewery or ask others to; and not use the page to harass members. A claim may be withdrawn or revoked if these terms are broken, if the person leaves the business, or on the brewery's request. Claiming is free. If we later offer optional paid tools for breweries, they will be described on revieweryapp.com/money and will never affect scores, rankings or search.

8. Disputes about a review

If you run a brewery and believe a review breaks the Community Guidelines, report it from the app or email [email protected] with the review and the reason. A person reviews every report and replies by email, usually within 7 days. A review that breaks the Guidelines is removed; a review that is merely negative is not, and scores are never edited by hand. We may share the outcome, but not the reporter's identity, with the review's author.

9. Brewery information

Brewery details (hours, location, tap lists, summaries) come from members, from the claimed brewery, and from automated sources, and are provided "as is". They may be wrong or out of date. Confirm with the brewery before making plans. The "What people say" summary on a brewery page is written automatically from member reviews and is not a statement by us or by the brewery.

10. Acceptable use

Don't attempt to break, probe, overload or reverse-engineer the app, the website or their backend; don't scrape or bulk-download content; don't automate accounts or submissions; don't use the app to violate any law or anyone's rights.

11. Disclaimers

The app and website are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. Reviews are the opinions of the members who wrote them, not ours. Drink responsibly; never drink and drive. Nothing in the app is advice about your health or safety.

12. Limitation of liability

To the maximum extent permitted by law, Heap Brands is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the app or website or from any content on them, even if advised of the possibility. The app is free; to the extent any liability cannot be excluded, it is limited to CAD $100. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.

13. Indemnity

You agree to defend and indemnify Heap Brands against claims, damages and reasonable costs arising from content you post, your breach of these terms, or your violation of anyone's rights, including a claim by a brewery about a review you wrote or by a person about a photo you uploaded.

14. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your account for breach of these terms or the Community Guidelines, with or without notice. Sections 4, 6 and 11–15 survive termination.

15. Governing law and venue

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. You agree that the courts of British Columbia have jurisdiction over any dispute, without prejudice to any right you have under the consumer-protection laws where you live.

16. Changes

We may update these terms. Material changes are signalled in the app before they take effect and listed with their date at revieweryapp.com/changes. Continuing to use the app after a change takes effect means you accept it.
